RATES, FEES, and TERMS & CONDITIONS SUBJECT TO CHANGE WITHOUT NOTICE. 

RECEIPT OF INITIAL PAYMENT FROM GUEST TO FRAN MAXON REAL ESTATE INC CONSTITUTES ACCEPTANCE OF ALL TERMS AND CONDITIONS SET FORTH BELOW.

Check-in and Checkout: Check-in begins at 4:00 PM EST on the arrival date specified on the most recent reservation confirmation. We cannot guarantee a 4pm check-in time during heavy turnover days, peak season and holidays and appreciate your patience during these times. Checkout time is 10:00 AM EST on the departure date specified on the most recent reservation confirmation. Rate adjustments will not be made for late check-in or early departure. Early check-ins are never guaranteed and late checkouts are not permitted. Guests failing to depart the rental unit at the specified checkout time will incur a $75 fee, to be charged to the Guest’s payment method on file. 

Keys: Guests who are provided keys to access the rental unit are required to return them to the Fran Maxon Real Estate office promptly after checkout. Lost or missing keys will result in a $50 charge to the Guest’s payment method on file. 

Reservations: A rental deposit equaling 20% of the reservation total is required in advance to confirm the reservation. (This amount will be applied to the reservation total.) Dates held without payment may be released anytime at the discretion of Fran Maxon Real Estate Inc. Reservations may be made online, by phone, or by email. Reservations shall be in the name of the person whose credit card has been used to book the reservation. Your reservation will NOT been fully confirmed until we are in receipt of a copy of valid ID (Driver’s License, State ID or passport) that matches the name on the credit card that was used to book your reservation. You have 48 hours to submit this documentation to us. You can text a picture of the front of the ID to us at 941-269-3057 or email a copy to rentals@franmaxonrealestate. Any group that has several people making payments on different cards is acceptable however each new credit card used will have to be accompanied by a Valid ID that matches the credit card used.  

Rental Payments: All rentals require the balance due to be paid at least 60 days prior to arrival. Payments are payable by e-check (ACH), check, money order, or credit card (Visa, MasterCard or Discover). Access to the rental property will not be provided if the reservation is not paid in full. No refunds will be made due to inclement weather, no-shows, or early departure. 

Taxes: All rentals of less than six (6) months are subject to Florida sales tax of 7%, (effective January 1, 2017), and a county tourist tax of 5% (effective June 1, 2009). This is in addition to the rental rate and fees. 

Cancelation Policy
Payment of reservation deposit is considered to be acceptance of cancellation terms regardless of the signature status of the rental agreement. All cancelations must be submitted in writing by the guest of record. 

Reservations of less than 30 nights: 

  • Bookings canceled at least 60 days prior to arrival will receive a full refund of the reservation total. 
  • Bookings canceled at least 30 days prior to arrival will receive a 50% refund of the reservation total. 
  • Bookings canceled less than 30 days prior to arrival will receive no refund of the reservation total. 
  • If the booking originated from a third-party bookings site, such as VRBO or Airbnb, please reference their specific cancelation policies. 

Reservations of 30 nights or more: 

  • Bookings canceled at least 90 days prior to arrival will receive a full refund of the reservation total. 
  • Bookings canceled at least 45 days prior to arrival will receive a 50% refund of the reservation total. 
  • Bookings canceled less than 45 days prior to arrival will receive no refund of the reservation total. 
  • If the booking originated from a third-party bookings site, such as VRBO or Airbnb, please reference their specific cancelation policies. 

Modifying the Reservation: Any modifications to the reservation after payment of the rental deposit, including but not limited to adding or removing nights, changing occupancy, or changing dates must be received in writing. Any such changes are considered a modification of this agreement. 

Changing the rental property will be considered a cancelation of the original reservation and will be subject to the cancelation policy. 

Nights removed from the reservation will be considered canceled and will be subject to the cancelation policy. Nights added to the reservation will be added using the posted rental rates at the time the night(s) are added. 

Rescheduling a reservation for arrival within the same month as the original reservation may be permitted within the cancelation policy penalty period as long as the requested dates are allowed by the rental schedule. The rental rate will be adjusted to the greater of the original reservation rate or the rental rate for the rescheduled dates and guest is responsible for resulting changes in reservation fees and taxes. 

Rescheduling a reservation for arrival in a different month than the original arrival date will be considered a cancelation of the original dates, regardless of whether the rental property remains the same, and will be subject to the cancelation policy. 

Travel Protection:  
Fran Maxon Real Estate offers travel insurance to our guests. Travel Insurance provides coverage for personal risks and expenses incidental to planned travel, including one or more of the following: 

  • Interruption, delay, or cancellation of a Planned Covered Trip 
  • Loss of or damage to baggage, luggage, or personal effects during a Planned Covered Trip or Event 
  • Damage to accommodations or rental vehicles 
  • Injury, illness, accident, disability, or death occurring during a Planned Covered Trip 

The retail premium charge for the Standard Travel Protection is 7% x trip cost. The upgraded protection adding the Cancel For Any Reason Benefit (CFAR) adds an additional 3.8% x trip cost (10.8% x trip cost in total). This coverage is available when your rental deposit is paid, but coverage is only in effect when we have received your premium payment. Eligibility requirements apply. Additional exclusions and limitations may apply if not purchased at the time of booking. 
 
If you purchase our recommended travel protection, we or the travel protection provider will send via email – to the email address provided to us by you – coverage information including the following: 
 
(a) A description of the material terms or the actual material terms of the insurance coverage. 
(b) A description of the process for filing a claim. 
(c) A description of the review and cancellation process for the travel insurance policy. 
(d) The identity and contact information of the insurer.

If you wish to cancel your travel insurance policy, your request must be made in writing. You may review the travel protection coverage documents, and if not satisfied, return the policy with a request for a full premium refund for up to 10 days from email-receipt of your coverage document. If the purchased travel insurance is not declined in writing and a refund requested within 10 days, then coverage is considered accepted and the premium payment is non-refundable, except for residents of any state or jurisdiction where pro-rata refunds may apply.

You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages.   1. (i) Purchasing travel insurance is not required in order to purchase any other product or service offered. (ii) If not individually licensed, no employee of Fran Maxon Real Estate is qualified or authorized to: (a) answer technical questions about the benefits, exclusions, terms and conditions of any of the insurance offered by Us; (b) evaluate the adequacy of the prospective insured’s existing insurance coverage.

Cleaning Fees: Will be charged in addition to the rent. Cleaning fees are determined based on the property’s size and amenities and cover reasonable cleaning upon guest departure. Excess cleaning charges will be charged to tenants. 

Damage Waiver Fee: The Damage Waiver Fee is a non-refundable fee that relieves Guests of the cost for reported unintentional and accidental damage to the Rental Property and its contents, up to $750. The fee amount is determined based on the length of stay. Any damage not reported to Fran Maxon Real Estate will not be covered and guests will be liable for all costs associated with unreported damage.  

The Damage Waiver Fee does not cover unreported accidental property damage, intentional damage, theft, unauthorized entry into the owner’s supply closet, unauthorized pets, extensive cleaning required at check-out, or smoking. In addition, violations of any law, ordinance, rule, or regulation resulting in charges/fines levied against the guest or visitors of the guest are not covered. 

Damages that are not covered, or that are in excess of $750, will be charged to the credit card on file immediately. Guests will be notified of charges in writing. 

Guests may choose to pay a $1500 refundable security deposit in lieu of the Damage Waiver Fee. Contact our office for more information. 

Booking Fee: A booking fee will be assessed on each reservation. 

Linen Service Fee: Rental homes utilizing a professional linen service will include a linen service fee to be determined based on the size of the property and occupancy limits. 
 
Pets: Pets are not permitted in any rental property unless specifically approved in writing. Rental properties advertised as pet-friendly may accept dogs. Other types of pets are not permitted. Fran Maxon Real Estate must be notified of pets at the time of booking. All pets require specific approval. If approved, a non-refundable pet fee of $150 per pet will be added to the reservation. In the event an unauthorized pet is discovered by Fran Maxon Real Estate Inc, the guest will be evicted immediately and all deposits and payments will be forfeited. An additional $500 fee will be charged to the payment method on file. Any costs required to return the rental property to its original condition will be charged in addition to the $500 fee. 

Approved pets must adhere to the following rules: 1) pets are not allowed on the furniture or in the pool/hot tub, 2) the yard must be kept free of waste, and 3) excessive hair must be cleaned prior to departure. Additional cleaning due to a pet will be charged to the guest at cost. Damage caused by pets is not covered by the Damage Waiver Fee. 

Smoking: Smoking is strictly prohibited in all rental properties. Smoking outdoors is permitted provided that smoking debris is responsibly discarded. Evidence of smoking inside a rental property will result in immediate eviction and forfeiture of all deposits and payments. An additional $500 fee will be charged to the payment method on file. Any costs required to return the rental property to its original condition will be charged in addition to the $500 fee. 

Occupancy: Occupancy is strictly limited by local ordinances and vacation rental licensing authorities. Maximum Occupancy is limited to the number of persons specified by the Rental Agreement and may not be exceeded under any circumstances. Parking at the rental property is limited to the number of vehicles and type of vehicles listed on the Rental Agreement. Boats, trailers, wave-runners, RV’s, etc. must be approved in advance and are subject to local ordinances. Parties and other gatherings are not permitted at any rental property. Parties, occupancy greater than the specified maximum, and/or unauthorized vehicles are grounds for immediate eviction and forfeiture of all deposits and payments. 

Minimum Age: Guest must be a minimum age of 25 years old on the day of arrival unless specifically approved in advance in writing. You agree to provide us with proof of age upon request. All persons staying at the property under the minimum age must be accompanied by their parent or legal guardian for the entire duration of the rental, provided that Guest may provide to Fran Maxon Real Estate the express written consent from the parent or legal guardian for any person under 25 years old who is going to stay at the property who is not a child or ward of Guest. We reserve the right to reject or terminate reservations made under false pretenses. Violations of this policy will result in the loss of all payments and immediate removal from the property without a refund.

Maintenance: In the event of equipment malfunction at a rental property we will expedite repairs as quickly as possible. Any maintenance items should be reported as soon as possible and may require vendors to repair and/or replace equipment. Should a service technician find the equipment is not in working order due to guest misuse, oversight, or neglect, the fee for the service will be charged to the guest. No rent adjustments can be made for circumstances beyond our control or for malfunction or loss of use of equipment or amenities. 

After-Hours Emergency Support: After-hours support is available for emergencies occurring outside normal operating hours. An emergency is an event that can cause harm to the guest, the home, or the property. Calls to the emergency line for non-emergencies will not be answered. 

Amenities: Each rental property is individually owned and reflects the tastes of the owners. Fran Maxon Real Estate describes rental properties and amenities to the best of its knowledge and ability, but cannot be held responsible if guests are dissatisfied with the accommodations. All amenities are subject to change without notice. 

Items Left In Unit: Neither the property owner nor Fran Maxon Real Estate, Inc will be held responsible for items left in the units. Items found may be mailed back via USPS Flat-Rate Priority shipping for a Mailback Fee of $25. Special mailing or shipping requests or requirements will be charged at cost in addition to the Mailback Fee. 

Telephones: All units include a landline phone in case of emergency. These phones are for local or emergency calling only. Long-distance calls are not permitted. 

Utilities: Basic utilities, including trash service, electricity, water, internet, and phone, are provided at no additional cost. 

Pools & Spas: Pools are not heated unless specified. Pool heat temperatures are set to approximately 83 degrees F. Spa temperatures are set to approximately 100 degrees F. If the ambient temperature falls below 60 degrees F for more than 5 hours, the pool heater may not function and may even switch off. Recovery times will vary and are not guaranteed. Fran Maxon Real Estate is not responsible for pool or spa temperatures, closures, or malfunctions. No credit, discount, and/or rate adjustment can be granted for items mentioned above or circumstances beyond our control. Fees may be charged to the guest to heat private pools. 

Substitution of Accommodations: Where circumstances arise beyond our control (i.e., fire, hurricane, sale of unit, change in status of property, etc.), your confirmed property may be unavailable upon your arrival. Fran Maxon Real Estate Inc reserves the right to substitute your accommodations. We cannot guarantee the confirmed rate in these instances. Although we will do everything possible to create a pleasant vacation experience, neither Fran Maxon Real Estate nor the property owner are liable for damages or inconvenience in this rare and unusual situation. If substitution cannot be provided the tenant will receive a full refund. 

Properties for Sale: In the event that the rental property is listed for sale, we may find the need to show the property during a guest’s stay with at least 24 hours’ notice. We will make every attempt to schedule the showing at a convenient time so as not to disturb your vacation. 

Internet Service: Many of our properties offer high-speed internet service for your convenience. Due to the numerous different providers and the various ages and configurations of personal computers, we cannot guarantee that you will be able to connect. We will do our best to assist you, but cannot be held responsible and no refunds will be offered if you are unable to take advantage of this service. 

Mail & Deliveries: Guest mail may not be sent to the rental property. If receiving mail is essential, guests may open a temporary Post Office Box with the local post offices in the City of Anna Maria, City of Holmes Beach, or City of Bradenton Beach. 

Condominium/Homeowners Associations: Guests occupying a unit governed by an association shall abide by all association rules and regulations. Guest may be asked to complete an application and fee subject to approval by the association. 

Entry of Premises: Guest agrees to allow Fran Maxon Real Estate’s vendors, contractors or subcontractors access to the rental property for any reason to make repairs, improvements, care for, or manage the property. Notice will be provided unless there is an emergency situation. 

Quiet use and enjoyment: Fran Maxon Real Estate does not guarantee quiet use or enjoyment of rental properties due to noise from other persons, neighboring properties, construction, maintenance, etc. Fran Maxon Real Estate cannot grant rate adjustments resulting from circumstances outside of the rental property. Per the City Noise Ordinance Quiet Hours are to be observed between the hours of 10 pm to 8 am daily. No excessive noise or amplified sound extending beyond the lot or parcel line is permitted. Fines will be issued for violations. 

Infectious Diseases: Rental properties are cleaned prior to guest arrival. However, Fran Maxon Real Estate Inc and the Property Owner cannot guarantee that infectious viruses and diseases will be completely eliminated by cleaning, or that infectious diseases and viruses are not brought to the property during the Guest’s occupancy. The Guest agrees that Fran Maxon Real Estate and the Property Owner are not responsible for any infectious diseases or viruses contracted during the Guest’s occupancy, and the Guest agrees to hold Fran Maxon Real Estate Inc and the Property Owner harmless from any loss, damage, or injury suffered by the Guest as a result of an infectious disease or virus which may be contracted while the Guest is staying in the property. 

Indemnity: Guest indemnifies Fran Maxon Real Estate Inc from and against any and all liability, loss damage and expense, including reasonable attorney fees and disbursements arising from injury to persons or damage to rental property; occasioned by the failure of the property owner to comply with any provision of law or this agreement; occasioned by any act or omission of the property owner or any person residing in or renting owner’s property; occasioned by any act of omission of the property owner, or property owner’s agents, servants, or contractors; or, occasioned by any act of omission, with the exception of such acts or commissions constituting gross negligence or willful misconduct of Fran Maxon Real Estate, its agents, servants, or contractors when acting as agent for the property owner as provided herein. Special risks may be involved when using pool and/or spas/hot tubs and guest assumes all responsibility for himself/herself and their guests and for the consequences of those at risk. Guest agrees to waive any claim whatsoever and hold harmless Fran Maxon Real Estate and the property owner for accidents and claims resulting from accidents and or injury arising from use of the rental property and any of its equipment, porches, decks, stairs, parking area, elevators, etc. 

Radon Gas: Radon gas is a naturally occurring radioactive gas that, when accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels that exceed Federal and State guidelines have been found in buildings in Florida. Additional information regarding Radon Gas and Radon testing may be obtained from the Manatee County Health Unit. 

Agency Disclosure: Pursuant to Florida Statutes Chapter 475, you are hereby notified that in connection with the property rented by this firm, Fran Maxon Real Estate, Inc is agent for the Owner and is being compensated as such by the Owner. Tenant acknowledges that this written notice was given, and is understood, prior to signing Rental Agreement, in compliance with all applicable Florida Statutes. 

Communication Policy: Information collected at the time of reservation (email, physical address, phone number(s), name) will only be used to contact you regarding that reservation with the exception of your email and physical address.  By providing your phone number you agree to receive text messages from our company. Message and data rates may apply. Message frequency varies. Your email and physical address will be used to send periodic newsletters, promotions, and other information pertaining to Fran Maxon Real Estate Vacation Rentals and Real Estate Sales.  At any time, you may unsubscribe from these communications by contacting us directly at rentals@franmaxonrealestate.com. Personal information collected at the time of reservation will not be shared or sold for any circumstance.   

Local Regulations Reference 

OCCUPANCY – Max Occupancy at this property 
Per your reservation agreement occupancy cannot exceed what is stated. 
The occupants’ acknowledgment and agreement that violation of the agreement or this chapter may result in immediate termination of the agreement and eviction from the vacation rental by the vacation rental owner or vacation rental agent, and potential liability for payment of fines levied by the city. 
 
TRASH & RECYCLING – ANNA MARIA 
City Ordinance requires that all rental properties have side door trash pick-up. 
Please do not haul your trash or recycling bins to the curb. 
Trash must be contained in bags. No loose garbage. 
Recycling must be loose, NOT contained in bags 
Recycling and trash pickup days are noted in the Guest Portal. 
Fran Maxon Real Estate should be informed immediately of any missed pickups. 
 
TRASH & RECYCLING – HOLMES BEACH 
City Ordinance requires that all rental properties have side door trash pick-up.

PARKING – Max # of Vehicles at this property 
All vehicles must be parked in garages or driveways and all four (4) tires must be off the roads. Avoid parking in yards, streets or right of ways. 
Vehicles parked in right-of-ways are permitted for a maximum time of 72 Hours. 
Boats/Trailers/RVs are NOT permitted on right-of-ways or streets. 
Boats/Trailers/RVs can be legally parked in driveways or side yards where available. 
Tickets will be issued and the guest will be responsible for payment of all fines. 
 
NOISE 
Noise ordinance Quiet Hours are in effect from 10:00 pm until 8:00 am daily. 
Use of pools, spas, and hot tubs during these hours is prohibited. 
Please be especially mindful of loud music and loud voices when in and around pools or outdoor balcony areas. Any noise above a whisper during quiet hours is in violation. 
Police will notify Fran Maxon and/or the Property Owner upon responding to a noise complaint. 
Guests may receive a citation (and will be responsible for payment) and could be evicted with no refund. 
Bottom Line … Not all of your neighbors are on vacation! Please use common courtesy and respect for those around you. 
 
TURTLE/BEACH REGULATIONS 
Turtle nesting season is from May 1st through October 31st each year. Sea turtles are protected by Federal and State laws. 
ALL OBJECTS MUST BE REMOVED FROM BEACH AT NIGHT (Canopies, tents, chairs, beach toys, umbrellas, trash). GUEST WILL BE RESPONSIBLE FOR PAYMENT OF MINIMUM $100 FINE. 
All lights visible from the beach are to be turned off or shielded. Please close blinds and curtains at night to shield indoor lighting. 
Dogs, bicycles, alcohol and open fires are NOT permitted on Manatee County beaches at any time. 
 
SECURITY/ SAFETY 
DO NOT ALLOW ANY UNAUTHORIZED SERVICE PERSONNEL INTO THE PROPERTY WITHOUT ADVANCE NOTICE FROM OUR OFFICE. 
Please call Fran Maxon at 941.778.2307 to report any maintenance issues or problems. 
All occupants must promptly evacuate from the vacation rental upon posting of any evacuation order issued by state or local authorities. 
Consent to the reasonable entry by the City of Anna Maria inspectors, Sheriff’s dept. and/or Fran Maxon Real Estate into the vacation rental to investigate any reports of code violations. 
Please call 911 for medical emergencies. 
Fire extinguisher can be found under the kitchen sink.

Acknowledgement Of Local Ordinances 

Please read and initial each of the following statements to signal your understanding and agreement: 
 
{____} I understand that violations of maximum occupancy may result in immediate eviction and potential liability for payment of fines levied by the City. 
 
{____} I understand that all vehicles must be parked in the garage or driveway, that parking signs must be followed, and that all four (4) tires must be off the pavement at all times. 
 
{____} I understand that boats/trailers/RVs may not be parked on right-of-ways or streets. 
 
{____} I understand that there is a noise ordinance in place prohibiting noise outside the unit between the hours of 10:00 PM and 8:00 AM. Use of pools, spas, or hot tubs is prohibited during these hours.

{____} I understand that objects may not be left on the beach for any reason. This includes, but is not limited to, canopies, tents, chairs, beach toys, umbrellas, or trash. 
 
{____} I understand that pets, bicycles, alcohol, and open fires are not permitted on Manatee County Beaches at any time. 
 
{____} I understand that lights are not permitted on the beach at night and that lights visible from the beach must be turned off or shielded (i.e. blinds drawn). This is for the protection of sea turtles, which are protected by Federal and State laws. 
 
{____} I understand that in the event of an evacuation order being issued by the State or Local authorities, all occupants must promptly comply. 
 
{____} I consent to reasonable entry by the City, Sheriff’s department, and/or Fran Maxon Real Estate into the vacation rental to investigate any reports of code violations. 
 
{____} I understand that tickets or fines levied for violations of any of the above are the responsibility of the guest. 

 
By confirming a reservation through a third party site (VRBO,Airbnb,booking.com, etc), guest agrees to the terms and conditions set forth above, acknowledge receipt and review of regulations and reservation details, and agree to the local ordinances as related to reservation.
